Patna High Court

Sunayana KumariversusThe State of Bihar through Pratyaya Amrit, the Additional Chief Secretary, Health Department

Decided
Disposal
DISMISSED

Holding

The court held that the contempt proceedings were to be dropped and the petition dismissed, granting the petitioner liberty to challenge the later order in the appropriate forum.

Summary

The petitioner, Sunayana Kumari, filed a writ petition seeking relief after the Director of I.G.I.M.S. issued a cryptic order (Letter No. 6058 dated 20‑11‑2025) purportedly complying with an earlier court order dated 29‑08‑2024. The petitioner alleged that the new order was unsatisfactory and caused further prejudice. The State argued that the order fully complied with the court’s earlier direction. The court examined whether the later order satisfied the requirements of the 29‑08‑2024 order and whether contempt proceedings should continue. Finding that the compliance was not demonstrably satisfactory, the court dropped the contempt proceedings and dismissed the miscellaneous jurisdiction petition, while allowing the petitioner to challenge the later order in the appropriate forum.

Issues considered

  • Did the order dated 20‑11‑2025 issued by the Director of I.G.I.M.S. comply with the court’s order dated 29‑08‑2024?
  • Should the contempt proceedings initiated against the opposite party be continued?
