Patna High Court

Kuldeep YadavversusDistrict Selection Committee, through District Magistrate, Jamui

Decided

DISPOSED

Holding

The contempt application was disposed of as the speaking order dated 19‑02‑2024 demonstrated compliance with the Court’s direction.

Summary

The petitioner, Kuldeep Yadav, filed a contempt application alleging that the District Magistrate of Jamui had failed to pass a fresh speaking order within three months as directed by the Patna High Court in its order dated 08‑01‑2024 in CWJC No. 17852 of 2015. The State argued that a speaking order dated 19‑02‑2024 had already been issued, indicating compliance with the Court’s direction, and therefore no fresh order was necessary. The Court examined whether the order dated 19‑02‑2024 satisfied the requirement of a fresh speaking order. Finding that the order showed compliance, the Court held that the contempt application could not proceed. Consequently, the contempt application was disposed of, and the petitioner was advised that he could challenge the matter in an appropriate forum if desired.
