Patna High Court

Durgesh Sharma @ Durgen SharmaversusThe State of Bihar, through the District Magistrate,

Decided
Disposal
DISPOSED

Holding

The petition is disposed as the encroachment has been removed under the statutory order and any further relief must be sought through alternative remedies.

Summary

Durgesh Sharma filed a writ petition challenging an alleged encroachment on his land. The Court noted that, pursuant to its earlier order dated 29‑09‑2022 in CWJC No. 4087 of 2021, the Circle Officer had issued a final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 on 05‑12‑2022 and the encroachment was physically removed on 07‑11‑2023. The opposite parties argued that the matter was already settled and that any remaining grievance could be pursued through other legal remedies. The Court agreed, granting liberty to approach alternative forums for any residual grievance and disposed of the petition. The petition was therefore dismissed.

Issues considered

  • Whether the petitioner's grievance persists after the removal order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956.
  • Whether the petitioner is entitled to any further relief from this Court.
