Vinod Kumar Manjhi, versusThe State of Bihar

Holding

The petition is disposed of as the respondents have complied with the earlier order, and no contempt is found.

Summary

Vinod Kumar Manjhi filed a contempt petition before the Patna High Court seeking initiation of contempt proceedings against the State of Bihar and several education officials for allegedly willfully disobeying the court's order dated 04‑09‑2019 in CWJC No. 18161 of 2019. The petitioner alleged that the opposite parties had failed to comply with the order, which required payment of a specified amount. The court examined a show‑cause notice and noted that a letter dated 13‑02‑2023 from the District Programme Officer, Establishment, Siwan, confirmed that a payment of Rs 2,58,206 had been made. On this basis, the court held that the grievance, if any, could be pursued through ordinary agitation rather than contempt proceedings. Consequently, the contempt petition was disposed of. The petitioner was granted liberty to raise any further grievance through appropriate channels.

Issues considered

  • What constitutes willful disobedience of the order dated 04‑09‑2019?
  • Whether the payment made by the District Programme Officer satisfies the court's earlier order, thereby negating contempt.

Subjects

  • contempt of court
  • civil writ jurisdiction
  • order compliance
  • education department
  • payment
