Patna High Court

Bharat Kumar MandalversusThe State of Bihar

Decided
Disposal
ALLOWED

Holding

The application for restoration was allowed, and the dismissed petition was reinstated to its original file.

Summary

On 26 April 2023, a petition (C.W.J.C. No.4398 of 2023) was listed for admission but the office clerk of the petitioner's advocate failed to mark the cause list, resulting in no appearance and the petition being dismissed for want of prosecution. The clerk subsequently filed an affidavit explaining the omission. The petitioner sought restoration of the dismissed petition, arguing that the dismissal was due to a clerical error rather than any substantive deficiency. The court examined the affidavit and considered the procedural nature of the lapse. Finding that the dismissal was not based on merit and that the petitioner was ready to prosecute, the court allowed the application. Consequently, the dismissed petition was restored to its original file for further hearing.
