Patna High Court

Ajay Kumar ThakurversusThe State of Bihar through Mr. Amrit Lal Meena, the Chief Secretary,

Decided
Disposal
DISPOSED

Holding

The Court held that the petition is consigned and the contempt petition is disposed of without finding contempt.

Summary

Petitioner Ajay Kumar Thakur filed a contempt petition alleging that, despite the High Court's order dated 08.05.2025, his dearness allowance, house rent allowance for a certain period, and the correct date of appointment were not reflected in Memo No. 1025 dated 08.10.2025. The State contended that it had complied with the court's order and that all consequential benefits had been granted. The Court examined the submissions of both parties, noted that the petitioner could still approach the concerned authorities for any remaining dues, and ultimately consigned the petition. No finding of contempt was made. The contempt petition was therefore disposed of.

Issues considered

  • Whether the State of Bihar complied with the High Court's order dated 08.05.2025 regarding payment of dearness allowance, house rent allowance and correction of appointment date.
  • Whether the petitioner’s contempt petition should be dismissed.

Subjects

  • contempt
  • civil writ jurisdiction
  • dearness allowance
  • house rent allowance
  • government employee benefits
  • court order compliance
