Holding

The court held that the contempt petition is not maintainable and disposed of it, granting the petitioner liberty to pursue any remaining grievance through appropriate proceedings.

Summary

Petitioner Runti Kumari filed a contempt petition seeking initiation of contempt proceedings against several State officials for allegedly willfully disobeying the order dated 25 June 2021 passed in CWJC No.8332 of 2020, which had reinstated her. The petitioner contended that a subsequent order terminated her employment and that this termination needed to be challenged. The court examined whether the opposite parties were in contempt of the earlier reinstatement order and whether the contempt petition was maintainable. It observed that the petitioner still has the liberty to agitate any remaining grievance through appropriate channels. Consequently, the court disposed of the contempt petition, allowing the petitioner to pursue any further relief separately.

Issues considered

  • Whether the opposite parties are in contempt for willful disobedience of the order dated 25.06.2021 in CWJC No.8332 of 2020
  • Whether a contempt petition is maintainable when the petitioner can pursue the grievance through other remedies

Subjects

  • contempt
  • civil writ jurisdiction
  • reinstatement
  • termination
  • ICDS
