Dr. (Smt.) Meera Singh @ Mira SinghversusThe State of Bihar

Holding

The court disposed of the contempt petition, finding no sufficient ground to proceed with contempt proceedings.

Summary

Dr. Meera Singh filed a petition seeking contempt proceedings against the State of Bihar and certain officials, alleging willful disobedience of a November 5, 2019 order that required a decision on her specialist doctor pay scale within three months and the consequent benefits within three months thereafter. The petition also sought a show‑cause notice to the State and the Joint Secretary of the Health Department, whose February 7, 2020 order had negated her claim. The court examined whether the respondents had willfully contravened the earlier order and considered the petitioner's right to agitate the matter. It granted the petitioner liberty to pursue the issue further but found no basis to proceed with contempt. Consequently, the contempt petition was disposed of.

Issues considered

  • Did the State of Bihar and its officials willfully disobey the order dated 5‑Nov‑2019 in C.W.J.C. No.19483 of 2019?
  • Should contempt of court proceedings be instituted against the opposite parties?

Subjects

  • contempt of court
  • writ jurisdiction
  • specialist doctor pay scale
  • government order compliance
  • show cause notice
