Holding
Since a reasoned and speaking order complying with the earlier judgment has been issued, the contempt proceedings are dropped and the petition dismissed.
Summary
The petitioners, three individuals, filed a Miscellaneous Jurisdiction petition seeking compliance with a judgment dated 12 January 2024 in Civil Writ Jurisdiction Case No. 3587 of 2020. They alleged that the State of Bihar had not yet issued a reasoned speaking order as required, and therefore asked the court to keep the matter pending pending a Supreme Court decision. The State contended that it had already issued the required order. Upon examination of the record, the High Court found that the State had indeed issued a reasoned and speaking order complying with the earlier judgment. Consequently, the court held that the petitioners could now pursue any further remedies and that there was no ground to continue the contempt proceedings. The court therefore dropped the contempt proceeding and dismissed the MJC petition.
Issues considered
- Whether the State of Bihar complied with the judgment dated 12 January 2024 in CWJC 3587 of 2020 by issuing a reasoned speaking order.
- Whether the contempt proceedings should continue in view of the alleged compliance.
