The contempt petition was disposed of as withdrawn.

Summary

Petitioner Raja Ram filed a contempt petition in the Patna High Court seeking civil contempt proceedings against the District Magistrate of Saharsa for allegedly willfully disobeying an order dated 22 November 2016 in C.W.J.C. No.15029 of 2013. The petition alleged that the order issued by Hon'ble Justice Shivaji Pandey had not been complied with in letter or spirit. During the hearing on 9 April 2026, counsel for the petitioner requested withdrawal of the petition, seeking liberty to challenge the order elsewhere. The court granted the liberty to withdraw and disposed of the contempt petition as withdrawn. Consequently, no contempt proceedings were initiated against the respondents.

Issues considered

  • Did the District Magistrate wilfully disobey the order dated 22.11.2016, constituting civil contempt?
  • Can the contempt petition be withdrawn after the court grants liberty to challenge the order?
