Patna High Court

Ram Chandra ChaudharyversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The petition is dismissed; the petitioner must appeal the order under the Bihar Government Servants Grievance Redressal Rules, 2019.

Summary

Ram Chandra Chaudhary filed a Miscellaneous Jurisdiction petition (No.235 of 2025) before the Patna High Court challenging an order dated 03‑09‑2024 issued by the Service Grievance Redressal Officer under the Bihar Government Servants Grievance Redressal Rules, 2019. The petitioner claimed to be aggrieved by that order and sought relief through a contempt proceeding. The Court observed that the Rules expressly provide a statutory right to prefer an appeal against the officer’s order. Consequently, the Court held that the appropriate remedy is an appeal before the designated appellate forum, not a contempt petition. The contempt proceeding was therefore dropped and the petition dismissed, with liberty granted to the petitioner to file an appeal under the Rules.

Issues considered

  • Whether the order of the Service Grievance Redressal Officer can be challenged through a contempt petition before the High Court.
  • Whether the petitioner must pursue the statutory appeal provided under the Bihar Government Servants Grievance Redressal Rules, 2019.
