Ranjit Singh Rana @ Ranjit SinghversusThe State of Bihar,

Decided
Disposal
DISPOSED

Holding

The petition is allowed and the dismissed civil writ case is restored, subject to payment of Rs. 500 to the Bihar State Legal Services Authority.

Summary

The petitioner, Ranjit Singh Rana, filed a miscellaneous jurisdiction application seeking restoration of his earlier civil writ jurisdiction case (CWJC No. 11844 of 2017) which had been dismissed for non‑prosecution on 17 June 2025. The High Court examined whether a dismissal for non‑prosecution could be set aside and the case reinstated. The Court held that the dismissal could be reversed provided the petitioner complied with a nominal payment requirement. Accordingly, the Court allowed the miscellaneous jurisdiction application, directing the petitioner to pay Rs. 500 to the Bihar State Legal Services Authority. Upon payment, the original CWJC was restored to its file.

Issues considered

  • Whether a dismissal for non‑prosecution under the Civil Procedure Code can be set aside by a High Court.
  • Whether the petitioner must satisfy any condition, such as payment of a fee, for restoration of the dismissed case.

Subjects

  • civil writ jurisdiction
  • restoration of case
  • non‑prosecution dismissal
  • High Court procedural order
  • payment condition
