DISPOSED

Holding

The contempt petition was dismissed because the respondents had demonstrated full compliance with the Court's earlier order.

Summary

The petitioners, a group of individuals from Dighwara, filed a contempt petition before the Patna High Court alleging that the State of Bihar and the Zila Parishad had failed to comply with the Court's order dated 7 April 2025 in Civil Writ Jurisdiction Case No.138 of 2024. The petitioners sought appropriate contempt proceedings against the respondents for the alleged non‑compliance. The respondents filed show‑cause notices, including supplementary and second supplementary show‑cause statements, asserting that the order had been fully complied with and that no further relief was required. The Court examined the show‑cause submissions and found that the respondents had indeed complied with the earlier order. Consequently, the Court held that there was no basis to continue the contempt proceedings and disposed of the contempt application.

Issues considered

  • What is the appropriate remedy when a party allegedly fails to comply with a High Court order in a civil writ case?
  • Does the filing of show‑cause and supplementary show‑cause statements indicating compliance negate the need for contempt proceedings?
