Decided
Disposal
DISMISSED

Holding

Since the petitioner has fully complied with the earlier orders, the grievance is deemed redressed and the contempt proceeding is dropped.

Summary

Shahin Bano, the petitioner, filed a civil writ jurisdiction petition against the State of Bihar, the Deputy Collector, and the National Highways Authority of India. The petitioner claimed that earlier orders dated 12.09.2023 and 21.09.2023 in CWJC No. 12194 of 2022 had been fully complied with, thereby redressing her grievance. The learned counsel for the petitioner submitted evidence of compliance before the High Court. The Court examined whether the compliance was sufficient to discharge the contempt proceedings. Finding that the petitioner’s grievance was indeed redressed, the Court ordered that the contempt proceeding be dropped. Consequently, the Miscellaneous Jurisdiction Case petition was dismissed.

Issues considered

  • Whether the petitioner has fully complied with the earlier orders dated 12.09.2023 and 21.09.2023.
