The Court dismissed the petition for contempt and disposed of the matter, granting the petitioners liberty to approach the appropriate authority if any grievance remains.
Summary
The petitioners, a group of residents of Saran district, filed a writ petition seeking initiation of contempt proceedings against several officials of the Bihar government for allegedly violating and disobeying an order dated 25 September 2023 issued in Civil Writ Jurisdiction Case No. 4077 of 2018. The earlier order had allowed the petitioners to approach the appropriate authority based on a letter from the District Magistrate. The opposite parties (officials) filed a show‑cause notice, contending that the Collector of Chapra had, on 5 January 2026, issued an order permitting a pay‑scale adjustment (3200‑85‑4900) in response to a representation. The Court, after hearing, granted liberty to the petitioners to raise any further grievance but disposed of the present petition without ordering contempt proceedings. The decision effectively upheld the Collector’s order and closed the matter.
Issues considered
- Whether the opposite parties are liable for contempt for allegedly violating the order dated 25‑09‑2023 in C.W.J.C. No. 4077 of 2018
- Whether the petitioners are entitled to any further relief beyond the liberty to approach the appropriate authority
Subjects
- contempt of court
- civil writ jurisdiction
- administrative order
- district magistrate
- pay‑scale order
- disobedience of court order
