Patna High Court

Chitranjan TiwaryversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The petition is disposed, with the petitioner granted liberty to challenge the District Magistrate’s order through the remedies available under law.

Summary

The petitioner, Chitranjan Tiwary, applied for an arms licence which was rejected by the District Magistrate, Rohtas, in a reasoned order dated 13‑Nov‑2024. The petitioner filed a writ petition challenging that order. The opposite parties informed the Court that the DM’s order had already been passed in compliance with the Court’s earlier direction dated 6‑May‑2024. The Court noted the existence of the DM’s order and, while granting the petitioner liberty to contest it through the appropriate legal remedies, held that no further hearing was required. Consequently, the Court disposed of the present petition. The order essentially leaves the petitioner to pursue any statutory remedy against the DM’s decision.

Issues considered

  • Whether the petitioner is entitled to challenge the District Magistrate’s order rejecting the arms licence application.
  • Whether the writ petition should proceed after the DM’s reasoned order has been issued.

Subjects

  • arms licence
  • writ jurisdiction
  • district magistrate order
  • petition disposed
