Holding

The contempt petition is disposed of, with a direction to the Finance Commissioner to furnish the calculation chart to the petitioner within four weeks.

Summary

Petitioner Eqbal Ahmed Jamshed filed a contempt petition alleging that the State had not complied with an order dated 09‑01‑2024 in C.W.J.C. No.14138 of 2008. The State submitted a show‑cause that the order was complied with, but the petitioner submitted an affidavit stating he had received a payment without the accompanying calculation chart and that the amount was less than his entitlement. The Court examined the submissions and found that the issue of the calculation chart remained unresolved. Consequently, the Court disposed of the contempt petition, granting the petitioner liberty to approach the Finance Commissioner (Opposite Party No. 2) to obtain the calculation chart within four weeks. The order thus directs the respondent to provide the required chart and does not impose any penalty for contempt.

Issues considered

  • Whether the State’s alleged compliance with the 09‑01‑2024 order amounts to contempt for non‑compliance.
  • Whether the petitioner is entitled to a calculation chart showing the amount payable.
