Holding

The Court held that the order directing the representation had been complied with, and therefore the contempt petition stands closed.

Summary

The petitioner, Arun Kumar Sinha, filed a contempt petition alleging wrongful fixation and non‑payment of pension arrears. The High Court had earlier directed the petitioner to make a representation before the Registrar of Veer Kuer Singh University, who was to dispose of it by a reasoned order. The University, through its counsel, showed that the Pay Verification Cell had fixed the petitioner’s basic pay under the 7th Pay Commission and that a pension of Rs.32,050 with admissible DA was determined, with arrears of Rs.2,233 payable. The Registrar’s order dated 10‑12‑2025 addressed the representation, and the Court found that the order had been complied with. Consequently, the Court held the contempt petition was no longer tenable and ordered it closed, directing the remaining arrears to be paid within four weeks.

Issues considered

  • Whether the contempt petition is maintainable after the petitioner’s representation on pension arrears has been disposed of by the University Registrar?
  • Whether the arrears of pension difference identified by the Pay Verification Cell are payable to the petitioner?
