Holding

The Court declined to order contempt proceedings, granting the petitioner liberty to pursue the matter through appropriate legal channels.

Summary

Petitioner Pervez Ahmad filed a petition seeking initiation of contempt of court proceedings against several officials of the Bihar Police and the District Magistrate for allegedly violating an order dated 23‑04‑2018 that directed the magistrate to expedite the grant of a license within four weeks. The petitioner claimed that more than four weeks had elapsed without compliance and that the District Magistrate had rejected his representation. The opposite parties filed a show‑cause memorandum indicating the magistrate's rejection of the representation. The Court, after hearing, allowed the petitioner to agitate the matter in accordance with law but did not order contempt proceedings. Consequently, the petition (MJC No. 3353 of 2018) was disposed of.

Issues considered

  • Whether the opposite parties willfully violated the order dated 23‑04‑2018 directing the District Magistrate to grant a license within four weeks.
  • Whether contempt of court proceedings can be initiated against the officials for the alleged non‑compliance.
