The Court grants the petitioner liberty to challenge the order of the Circle Officer by availing other legal remedies.

Summary

The petition filed by Pramod Kumar Gupta sought liberty to challenge an order dated 01‑12‑2025 passed by the Circle Officer, Brahmpur, which had disposed of an encroachment appeal on the ground that the alleged encroachers had filed Title Suit No.576 of 2021 and Title Suit No.578 of 2021. The petitioner argued that no injunction had been granted in those title suits, and therefore the encroachers remained in possession of the land, warranting a fresh challenge. The Court noted that the encroachment appeal had already been disposed of but held that the petitioner could still be granted liberty to contest the order by invoking any other legal remedies available. Consequently, the Court granted the requested liberty. The petition was thereafter disposed off.

Issues considered

  • Whether the petitioner is entitled to liberty to challenge the Circle Officer's order dated 01‑12‑2025 disposing the encroachment appeal.
  • Whether the absence of an injunction in the pending title suits affects the validity of the encroachment order.

Subjects

  • encroachment
  • civil writ jurisdiction
  • injunction
  • administrative order
  • challenge of order
