Holding
The Court held that, given the issuance of the CEO’s memo addressing the earlier directions, the contempt petition could be disposed of, granting the petitioner liberty to take any further appropriate steps.
Summary
The petitioner, Pravin Kumar, filed a contempt petition (MJC No.3517 of 2023) alleging that the State of Bihar, its mining officials and the Bihar State Mining Corporation (BSMC) had willfully ignored the directions of a prior judgment dated 20‑07‑2023 in CWJC No.4476 of 2023. The petitioner sought initiation of contempt proceedings and punishment of the opposite parties. The learned senior counsel submitted that BSMC’s Chief Executive Officer had issued a memo (No.568 dated 10‑09‑2025) addressing the matters raised in the earlier judgment, thereby rendering the contempt petition unnecessary. The Court, after considering this submission, granted liberty to the petitioner to pursue any further appropriate steps and disposed of the contempt petition. Consequently, the petition was effectively dropped without any finding of contempt.
Issues considered
- Whether the opposite parties are in contempt of the Court for not complying with the directions of the judgment dated 20‑07‑2023 in CWJC No.4476 of 2023.
- Whether the contempt petition can be dismissed in view of the subsequent order (Memo No.568 dated 10‑09‑2025) issued by the CEO of BSMC.
