Devendra PrasadversusThe State of Bihar

Decided
Disposal
WITHDRAWN

Holding

The contempt application is withdrawn with liberty to the petitioner to challenge the resolution dated 08‑07‑2024.

Summary

The petitioner, Devendra Prasad, obtained relief in Letters Patent Appeal No.1302/2017, which restored him to his position, awarded back wages, and secured pension benefits. The State of Bihar officials were subsequently alleged to have willfully disobeyed the order, prompting the petitioner to file a contempt application (C.W.J.C. No.934/2016). During the hearing, counsel for the petitioner sought to withdraw the contempt application, seeking liberty to challenge a later resolution dated 08‑07‑2024 issued by the Additional Secretary‑cum‑Director. The Court considered the request and allowed the withdrawal, granting the petitioner liberty to contest the said resolution in a separate proceeding. Consequently, the contempt application was disposed of as withdrawn.
