Ramesh ChandraversusThe State of Bihar through the Principal Secretary, Department of Education,

Decided
Disposal
DISPOSED

Holding

The order is modified to read "Director, Secondary Education, Government of Bihar, Patna" and no further modification is required.

Summary

The petitioner, Ramesh Chandra, filed an application seeking modification of the order dated 09-10-2025 to correct the name of Respondent No. 3 in the cause title of the writ petition from "Director, Primary Education" to "Director, Secondary Education". The petitioner also claimed that incorrect letter numbers and annexures were cited in the prayer portion of the writ petition and submitted a supplementary affidavit with the correct documents. The Court held that the cause‑title correction could be made and ordered the name to be read as "Director, Secondary Education, Government of Bihar, Patna". Regarding the other prayer, the Court noted that the writ petition (C.W.J.C. No. 7359 of 2025) had already been disposed of with directions to the District Programme Officer (Establishment), Khagaria, to consider the claim in light of Full Bench decisions, and therefore no further modification was required. The petitioner was allowed four weeks to file any additional documents before the District Programme Officer. The modification application was consequently disposed of.

Issues considered

  • Whether the order dated 09-10-2025 can be modified to correct the name of Respondent No. 3 in the cause title of the writ petition.

petition be read as “The Director, Secondary Education,

petitioner has, by mistake, mentioned incorrect letter numbers

and has also appended incorrect letter(s) as annexure(s), for

which a supplementary affidavit has been filed bringing the
