Decided
Disposal
DISPOSED

Holding

The petition is disposed of as the respondents have shown compliance through an order dated 2 March 2026, leaving no ground for contempt proceedings.

Summary

Uday Sharma filed a writ petition seeking to initiate contempt proceedings against several Bihar government officials, alleging they willfully violated an order dated 10 July 2025 issued in Civil Writ Jurisdiction Case No. 10730 of 2025. The respondents submitted an affidavit indicating that a subsequent order was passed on 2 March 2026 addressing the matter. The court examined whether the alleged violation persisted despite the later order. Finding that the respondents had taken action, the court held that the petitioner could still raise a challenge if desired, but there was no basis to proceed with contempt at this stage. Consequently, the petition was disposed of.

Issues considered

  • Whether contempt proceedings can be initiated against the respondents for alleged wilful violation of the order dated 10 July 2025.
  • Whether the filing of a subsequent order on 2 March 2026 bars the petitioner's contempt application.
