Holding

The petition is disposed of as not pressed, with liberty granted to the petitioner for any further appropriate remedy.

Summary

The petitioner, Rajnish Kumar, filed a writ petition against the State of Bihar and several officials alleging a grievance despite an earlier court order dated 07‑09‑2022 directing proceedings under Section 133 of the Criminal Procedure Code. The opposite parties informed the Court that those proceedings had already been concluded by an order dated 31‑03‑2023 issued by the Sub‑Divisional Officer, Lakhisarai. The petitioner then sought any further legal remedy for his remaining grievance. The Court, after noting the compliance with the earlier order, granted the petitioner liberty to seek appropriate relief but held that the petition was not pressed and therefore disposed of it. Consequently, the petition was dismissed as there was no pending issue requiring adjudication.

Issues considered

  • Whether the petition remains maintainable after the completion of proceedings under Section 133 CrPC as ordered by the Court.
  • Whether any further relief can be granted to the petitioner despite the concluded proceedings.
