Patna High Court

Rama Nand ChoudharyversusThe State of Bihar through the Principal Secretary,

Decided
Disposal
DISMISSED

Holding

The court held that the order had been complied with, and therefore the contempt proceedings were dropped.

Summary

The petitioner, Rama Nand Choudhary, filed a miscellaneous jurisdiction application (MJC No.3802 of 2024) alleging that the order dated 5 July 2023 in Civil Writ Jurisdiction Case No.20480 of 2018 had not been complied with by the State of Bihar and its officials. The respondents contended that a show‑cause notice and an annexure (Memo No.12 dated 21 August 2025) demonstrated that the order had already been complied with. The court examined the submissions and the annexure, finding that the compliance had indeed been effected. Consequently, the contempt proceedings initiated on the basis of alleged non‑compliance were deemed unnecessary. The court dismissed the MJC application, granting the petitioner liberty to approach the appropriate authority if any grievance remained.

Issues considered
