Patna High Court

Purooshottam Nath SinghversusThe State Of Bihar and Ors

Decided

DISPOSED

Holding

The Court held that the respondents had not committed contempt as the earlier order was complied with.

Summary

The petitioner, a retired headmaster, filed a petition seeking contempt proceedings against the State of Bihar and several officials, alleging that they willfully disregarded a judicial order dated 23 April 2018 issued in CWJC No. 7193/2018. The earlier order had disposed of the writ application with specific observations and directions. The petitioner’s counsel argued that the order had been complied with, contrary to the alleged contempt. The Court examined whether the respondents had indeed flouted the prior order and whether contempt proceedings were warranted. Finding no evidence of non‑compliance, the Court disposed of the contempt petition, granting the petitioner liberty to raise any further grievance in accordance with law.

Issues considered

  • Did the respondents commit contempt of court by allegedly flouting the order dated 23 April 2018 in CWJC No. 7193/2018?
  • Is there sufficient basis to initiate contempt proceedings against the State of Bihar and its officials?

Subjects

  • contempt of court
  • civil writ jurisdiction
  • compliance with judicial order
  • state liability
  • administrative officials
