Patna High Court

Raj Kumar BhagatversusThe State of Bihar

Decided

DISPOSED

Holding

The Court held that the contempt application is dismissed as the representation was already disposed of by the order dated 18‑03‑2026.

Summary

The petitioners, a group of landowners, filed a contempt application alleging that the State of Bihar and its officials misled the Patna High Court by claiming readiness to pay land acquisition compensation as directed in earlier orders dated 06‑01‑2020 (C.W.J.C. No.17769/2018) and 28‑03‑2024 (C.W.J.C. No.14595/2023). The petitioners contended that the State had not complied with the direction that individual applications to the concerned authority should be concluded within one year. The State, represented by the Housing Board, submitted that the matter had been resolved by an order dated 18‑03‑2026. The Court examined whether the respondents’ statements amounted to contempt and whether the 18‑03‑2026 order satisfied the earlier directive. Finding that the representation was indeed disposed of by the later order, the Court held that there was no ground for contempt and consequently dismissed the contempt application.

Issues considered

  • Whether the respondents committed contempt of court by allegedly misleading the High Court regarding the payment of land acquisition compensation.
  • Whether the order dated 18‑03‑2026 satisfies the earlier directive that individual applications be concluded within one year.
