Holding
The Court held that the DGP’s reasoned order granting the petitioners liberty to challenge the earlier order complied with the High Court’s directions, and therefore the petition was disposed.
Summary
The petitioners, a group of individuals, filed a writ petition challenging the alleged non‑compliance of a prior High Court order dated 15‑02‑2024 in CWJC No.893 of 2024. The State, represented by the Home Police Department and senior police officials, submitted that the Director General of Police had issued a reasoned order granting the petitioners liberty to challenge the order through other legal remedies. The petitioners sought confirmation of this liberty and enforcement of the earlier order. The Court examined whether the DGP’s order satisfied the requirements of the earlier judgment and whether the petitioners were entitled to the granted liberty. Finding that the DGP had indeed provided a reasoned order and liberty to challenge, the Court affirmed the order and disposed of the petition. Consequently, the petition was dismissed as the relief sought was already granted by the DGP’s order.
