Patna High Court

Jitendra Prasad singhversusThe State of Bihar through Sri Arvind Kumar Choudhary,

Decided
Disposal
DISMISSED

Holding

The contempt proceeding is dropped and the MJC application is dismissed.

Summary

The petitioner, Jitendra Prasad Singh, filed a Miscellaneous Jurisdiction Case (MJC) against the State of Bihar and several senior police officials, seeking redress for alleged non-payment of dues. The petitioner’s counsel argued that only a part payment had been made and that the order issued did not satisfy all his grievances. The respondents contended that the full amount of the admitted dues had already been paid. The Court examined whether the contempt proceedings should continue and whether the MJC application warranted further consideration. Concluding that the contempt proceedings were no longer viable, the Court dismissed the MJC application while granting the petitioner liberty to approach the appropriate authority if any grievance remains.

Issues considered

  • Whether the contempt proceedings should be continued
  • Whether the Miscellaneous Jurisdiction Case should be entertained or dismissed
