Holding
The court disposed of the contempt petition, finding that the university had satisfied the payment requirement and no contempt had occurred.
Summary
Kamla Kant Singh filed a petition seeking contempt proceedings against Veer Kunwar Singh University officials for allegedly refusing to comply with a court order dated 12 April 2018 that required payment of certain receipts within four months. The order in CWJC No. 6434 of 2018 had directed the university to ensure the payment. The university, through counsel, produced Annexure‑A showing that the dues for the period December 1986 to February 2018 had already been paid by the college. The court examined the evidence and found that the alleged non‑compliance was not substantiated. Consequently, the court held that there was no ground for contempt. The contempt petition was therefore disposed of.
Issues considered
- Did the university officials wilfully disobey the order dated 12‑04‑2018 directing payment of receipts?
- Has the required amount for the period December 1986 to February 2018 been paid?
- Should the contempt petition be entertained or dismissed?
