Dr. Satish Prasad Singh, versusThe State Of Bihar

Decided
Disposal
DISPOSED

Holding

The Court disposed of the contempt petition, finding no basis to proceed with contempt proceedings.

Summary

Dr. Satish Prasad Singh filed a contempt application (MJC No. 4172 of 2018) alleging that the State of Bihar and officials of B.R.A. Bihar University wilfully violated an earlier order dated 22 June 2018 in C.W.J.C. No. 5865/2018. The petitioner sought initiation of contempt proceedings and appropriate punishment. The respondents filed a show‑cause letter (B/285 dated 07‑02‑2019) asserting that the earlier order had been complied with and the petitioner's representation disposed of. The Court granted the petitioner liberty to agitate the matter if desired but ultimately disposed of the contempt petition without further order. Consequently, the application for contempt was dismissed and the matter closed.

Issues considered

  • Whether the respondents willfully violated the order dated 22‑06‑2018 in C.W.J.C. No.5865/2018.
  • Whether the show‑cause submission by the respondents suffices to demonstrate compliance with the earlier order.
  • Whether contempt of court proceedings should be initiated against the respondents.

Subjects

  • contempt of court
  • writ jurisdiction
  • university administration
  • compliance with court order
  • show cause
