Holding

The court granted an eight‑week extension of time to the petitioner.

Summary

Petitioner Rani Singh sought an extension of the time granted by the Patna High Court on 1 September 2025 to approach the appropriate authority within four weeks. She claimed that due to lack of communication she could not file within that period and requested an additional eight‑week extension. The State of Bihar raised no objection. Justice Rajiv Roy considered the petitioner's explanation and the absence of opposition, and ordered that the petition be allowed, extending the time by eight weeks, subject to a nominal payment of Rs.1,000 to the Court’s Legal Services Committee. The order effectively permits the petitioner to file the required application within the extended period.

Issues considered

Subjects

  • extension of time
  • civil writ jurisdiction
  • procedural law

                   following relief(s):

connection with C.W.J.C. No. 4821/2017 passed by

Hon'ble Mr. Justice Rajiv Roy of this Hon'ble court

                                    on 01.09.2025.”

                                 3. On 01.09.2025, CWJC No. 4821/2017 (Rani Singh

vs. The State of Bihar & Ors.) was disposed of allowing the

petitioner to approach the appropriate authority/Court in next

                    four weeks.

                                 4. Now the modification has been filed and the

submission is that for want of communication, the petition could

not be filed and as such, the period be extended by further eight

                    weeks.

                                 5. Learned State counsel has no objection.

                                 6. In that background, MJC No. 4242 of 2025 stands

allowed allowing the petitioner to approach the appropriate

authority/Court in next eight weeks. This is subject to payment

of Rs. 1,000/- to the Patna High Court Legal Services

Committee which in turn will go to SUVAS CELL (Patna High

Court) for the purchase of flower pots.
