Holding
The Court held that the petitioners may withdraw the M.J.C. petition and are entitled to prefer an appeal under the Bihar Government Servants Grievance Redressal Rules, 2019.
Summary
The petitioners, a group of nineteen residents of Sitamarhi district, filed a Miscellaneous Jurisdiction Civil Writ petition before the Patna High Court challenging actions of the State of Bihar and its officials. They later sought the Court's permission to withdraw the petition and instead pursue a remedy under the Bihar Government Servants Grievance Redressal Rules, 2019. The Court considered whether such a withdrawal was permissible and whether the petitioners could be directed to use the grievance redressal mechanism. After hearing counsel, the Court granted the petitioners' request to withdraw the petition. Consequently, the petition was dismissed as withdrawn, with liberty to the petitioners to file an appeal under the specified grievance redressal rules within the prescribed time frame.
