Holding

The court held that the order dated 20‑06‑2017 had been complied with, and therefore the petition for contempt was dismissed.

Summary

The petitioner, Kashi Yadav, filed a petition seeking initiation of contempt proceedings against Opposite Party No.5 for allegedly willfully violating a judicial order dated 20‑06‑2017 issued in C.W.J.C. No.18889 of 2013, which required removal of an encroachment within four weeks of receipt of the order. The respondents filed a show‑cause notice stating that the encroachment had been removed on 15‑10‑2020 and that the petitioner’s signature acknowledged the compliance. The court examined the show‑cause submission and accepted that the order had indeed been complied with. Consequently, the court found no ground for contempt. The petition was therefore disposed of, with no contempt proceeding initiated.
