Holding

The Court grants the petitioners liberty to challenge the order and disposes of the petition.

Summary

The petitioners, a group of individuals from various districts of Bihar, filed a writ petition challenging the State of Bihar and its officials for allegedly disobeying an earlier order dated 15.02.2024 in CWJC No.494 of 2024. The petition sought liberty to contest a reasoned order issued by the Director General of Police, Bihar, which the petitioners claimed was insufficient. The learned counsel argued that despite the DGP’s compliance, the petitioners should be allowed to pursue further remedies. Justice Mohit Kumar Shah examined whether the petitioners were entitled to such liberty and whether the petition remained maintainable. The Court granted the petitioners liberty to challenge the order through appropriate legal avenues and consequently disposed of the petition.

Issues considered

  • Whether the petitioners are entitled to liberty to challenge the reasoned order passed by the Director General of Police
  • Whether the petition remains maintainable after the alleged compliance with the earlier court order

Subjects

  • civil writ jurisdiction
  • administrative order
  • liberty to appeal
  • non‑compliance with court order
  • high court discretion
