Holding

The petition for contempt proceedings was not entertained and the matter was disposed of.

Summary

The petitioner, Ashok Kumar Shahi, filed a petition seeking initiation of contempt proceedings against B.R. Ambedkar Bihar University and related officials for allegedly failing to comply with a court order dated 31 July 2019 in CWJC No. 15419 of 2019. The university had issued a reasoned order through memo No. B/1518 on 20 July 2023, which the court considered in evaluating the petition. The High Court examined whether the alleged non‑compliance justified contempt proceedings. The court granted the petitioner liberty to agitate the matter if he wishes, but ultimately disposed of the petition without ordering contempt proceedings. The order reflects the court’s view that the matter does not warrant further judicial intervention at this stage.

Issues considered

  • Whether the respondents’ alleged failure to comply with the order dated 31‑07‑2019 amounts to contempt of court
  • Whether the petitioner is entitled to a fresh contempt proceeding against the university and its officials

Subjects

  • contempt of court
  • civil writ jurisdiction
  • non‑compliance with court order
  • B.R. Ambedkar Bihar University
