The contempt petition is dismissed as withdrawn.

Summary

The petitioner, Md. Mohsin Alam, filed a contempt petition seeking initiation of contempt proceedings against several officials for allegedly violating a High Court order dated 07-11-2017 that directed the Circle Officer of Block-Balrampur to commence action under section 3 of the Public Land Encroachment Act to remove encroachments on specified plots. The petition sought to enforce compliance with that order. During the hearing, counsel for the petitioner indicated that the matter had become infructuous and requested permission to withdraw the petition. The Court considered whether the withdrawal was permissible and whether a contempt proceeding could be entertained after the petition was withdrawn. Finding that the petitioner wished to abandon the relief, the Court allowed the withdrawal and dismissed the contempt petition. Consequently, no contempt proceedings were initiated and the matter was closed.

Issues considered

  • Whether the contempt petition should proceed despite the petitioner's request to withdraw.
  • Whether the withdrawal of the petition amounts to a dismissal of the contempt proceedings.

Subjects

  • contempt of court
  • public land encroachment
  • withdrawal of petition
