Holding

The contempt application is dismissed as the order dated 18‑09‑2018 has been complied with.

Summary

The petitioner, Niranjan Kumar, filed a contempt application alleging that the National Highways Authority of India and other respondents failed to comply with an order dated 18 September 2018 issued by a coordinate bench of the Patna High Court in CWJC No. 15644 of 2018. The petitioner claimed that the respondents had not implemented the directions of that order. The respondents, through their counsel, argued that the order had been fully complied with. The court examined the submissions and found that the petitioner’s claim of non‑compliance was unsubstantiated. Consequently, the court disposed of the contempt application, effectively dismissing it. The order of the coordinate bench therefore stands as complied with.

Issues considered

  • Whether the respondents failed to comply with the order dated 18‑09‑2018 issued in CWJC No. 15644 of 2018.
