Holding

The contempt petition is disposed of, with the petitioner permitted to approach the court again if any grievance remains.

Summary

The petitioner, Akhilesh Kumar, filed a contempt petition against several officials of the State of Bihar seeking initiation of contempt proceedings and punishment for alleged willful disobedience of a court order dated 25‑02‑2020 in C.W.J.C. No.2638/2020. The respondents filed a show‑cause notice and the State counsel relied on a memo dated 21‑02‑2022 in which the Collector, Nawada, had passed a reasoned order addressing the grievance. The High Court, after hearing both sides, granted the petitioner liberty to raise any further grievance if it still existed, and consequently disposed of the contempt petition. No specific contempt finding was made, and the matter was left open for future agitations by the petitioner. The order effectively dismissed the contempt application without imposing any penalty.

Issues considered

  • Did the respondents willfully and deliberately disobey the order dated 25‑02‑2020, thereby committing contempt of court?
  • Should the contempt petition be entertained and appropriate punishment imposed?

Subjects

  • contempt of court
  • civil writ jurisdiction
