Satyendra Narayan SinghversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court waived the Rs.2000 cost, warned the State respondents, and disposed of the petition as no further relief remained.

Summary

The petitioner, Satyendra Narayan Singh, filed a writ petition alleging that his boundary wall was demolished by certain accused and that the police, despite lodging an FIR and filing a charge sheet, failed to provide protection or facilitate reconstruction. The State argued that the matter was a private dispute referred to the District Civil Law Report (DCLR) and that the Superintendent of Police had complied with the court's earlier order. The petitioner also sought to modify a prior order imposing a Rs.2000 cost on the respondents. The court, after considering an interlocutory application, waived the cost with a warning to the State and directed the petitioner to approach the appropriate authorities for redress. Since no further relief remained, the court disposed of the petition.

Issues considered

  • What relief, if any, is available to the petitioner for police inaction after an FIR and charge sheet were filed
  • Whether the Rs.2000 cost imposed on the State respondents can be waived
  • Whether the petition remains maintainable after the matter was referred to the DCLR as a private dispute

Subjects

  • boundary wall demolition
  • police protection
  • FIR
  • charge sheet
  • cost waiver
  • petition disposal
  • private dispute
