Patna High Court

Rajendra YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that no contempt had occurred as the Circle Officer had complied with the earlier order.

Summary

Petitioner Rajendra Yadav filed a contempt petition alleging that the State of Bihar and its officials willfully disobeyed the High Court's order dated 25 July 2023 in C.W.J.C. No. 3466 of 2023. The petitioner claimed the order had not been implemented, while the State contended that the Circle Officer had issued an order in compliance, which was attached as Annexure‑B. The Court examined Annexure‑B and found that the Circle Officer had indeed passed the required order and communicated it to the petitioner. Consequently, the Court held that there was no contempt of its earlier order. The contempt proceeding was therefore dropped and the petition dismissed, with liberty granted to the petitioner to challenge the Circle Officer's order in the appropriate forum.
