Holding

The Court disposed of the petition, granting the petitioner liberty to initiate contempt proceedings against the respondents.

Summary

Petitioner Nirmala Singh filed an application seeking to initiate contempt proceedings against several officials of the Bihar government for allegedly willfully violating a prior order dated 08‑08‑2023 in Misc. Jurisdiction Case No. 4240 of 2018. The petition alleged that the District Programme Officer, Establishment, Muzaffarpur had already passed an order contrary to the earlier judgment. The High Court heard the matter on 16‑01‑2026, examined the show‑cause notice, and considered whether the respondents’ actions amounted to contempt. The Court granted liberty to the petitioner to pursue the contempt action and disposed of the present petition (MJC No. 688 of 2025). The order effectively cleared the way for contempt proceedings against the respondents.

Issues considered

  • Did the respondents willfully and deliberately violate the order dated 08‑08‑2023?

  • Whether the petition seeking contempt relief should be entertained?
