Decided
Disposal
DISMISSED

Holding

The court held that since the order dated 21 September 2023 had been complied with, the contempt proceeding could not continue.

Summary

The petitioner, Jagdish Paswan, filed a contempt petition in the Patna High Court alleging that the respondents, various government officials, had failed to comply with an order dated 21 September 2023 issued in Civil Writ Jurisdiction Case No.6897 of 2023. The respondents contended that they had already complied with the said order. The court examined the submissions and found that the compliance had indeed been effected. Consequently, the court held that there was no ground to continue the contempt proceedings. The petition was therefore dismissed, and the contempt proceeding was dropped.

Issues considered

  • Whether the respondents had complied with the order dated 21 September 2023 issued in C.W.J.C. No.6897 of 2023.
  • Whether the contempt petition should be dismissed on the basis of such compliance.
