The Court held that the petition was infructuous due to the lapse of time and disposed of it, while allowing the petitioner to re‑agitate the matter if required.
Summary
The Simariya Ghat Dukandar Welfare Society filed a petition seeking the initiation of contempt proceedings against the State of Bihar and several officials, alleging willful disobedience of an order dated 23 January 2015 in Civil Writ Jurisdiction Case No. 21587 of 2014. The petition was filed under Miscellaneous Jurisdiction Case No. 779 of 2015. The High Court examined whether the contempt petition could be entertained after a considerable lapse of time. The Court observed that the passage of time had rendered the matter infructuous, effectively defeating the purpose of the contempt action. However, the Court granted the petitioner liberty to raise the issue anew if circumstances later warranted it. Consequently, the Court disposed of the petition without ordering contempt proceedings.
