Punita KumariversusThe State Of Bihar, Through The Principal Secretary, Human Resources Development, Govt. Of Bihar, P

Holding

The court held that since the respondents released the ordered amount, there was no contempt of court.

Summary

Petitioner Punita Kumari filed a contempt petition alleging that the State of Bihar and officials of L.N. Mithila University willfully disobeyed a prior court order directing payment of dues to her. The earlier orders (C.W.J.C. No.1377 of 2010 and M.J.C. No.1788/2011) required the respondents to pay a specified amount within a prescribed time. The respondents submitted Annexure‑A showing that Rs.21,92,795 had been released to the petitioner. The court examined whether the payment satisfied the earlier decree and whether any contempt existed. Finding that the amount had indeed been released, the court concluded that the respondents had complied and therefore no contempt was established. The petition was consequently disposed.

Issues considered

  • Did the respondents willfully disobey the earlier court order by failing to pay the dues to the petitioner?
  • Whether the release of Rs.21,92,795 constitutes compliance with the earlier order, thereby negating contempt?
