Patna High Court

Subhash Chandra Mishra, versusLalit Narayan Mithila University,

Decided
Disposal
DISPOSED

Holding

The court held that the order dated 10‑04‑2019 stands complied and therefore dismissed the petition for contempt.

Summary

The petitioner, Subhash Chandra Mishra, filed a petition seeking the initiation of contempt proceedings against Lalit Narayan Mithila University and related officials, alleging that they willfully violated a court order dated 10 April 2019 in MJC No. 1884 of 2018. The petitioner claimed that despite receiving a grant of Rs. 63,10,967 from the State, there remained a grievance requiring legal redress. The court examined the show‑cause statement and noted that the petitioner had indeed been awarded the said amount. Observing that the earlier order had been complied with, the court granted the petitioner liberty to agitate the matter further but found no basis to proceed with contempt. Consequently, the petition was disposed of without ordering contempt proceedings.

Issues considered

  • Whether the respondents have willfully violated the order dated 10‑04‑2019 in MJC No. 1884 of 2018.
