Patna High Court

Krishna ChandraversusMr. Satish Chandra Jha,

Decided
Disposal
DISPOSED

Holding

The petition for contempt was dismissed as the respondents had complied with the earlier court order.

Summary

The petitioners, Krishna Chandra and Jai Nandan Prasad, filed a writ petition seeking initiation of contempt proceedings against several officials of the Bihar education system for allegedly willfully disobeying a court order dated 5 August 2019. The petition alleged that the respondents had not complied with the order in CWJC No. 7919 of 2016. The respondents filed a show‑cause notice indicating that a subsequent order dated 15 March 2021, communicated through memo no. 1126, had been issued by the District Education Officer, Vaishali, rejecting the petitioners' claim and thereby complying with the earlier court direction. The court examined the show‑cause and the compliance order and found that the respondents had indeed acted in accordance with the court’s earlier direction. Consequently, the court held that there was no ground for contempt and granted liberty to the petitioners to agitate the matter further if needed. The matter was therefore disposed of without initiating contempt proceedings.
