WITHDRAWN

Holding

The contempt petition stands closed with liberty to the petitioners to assail the order if so advised.

Summary

The petitioners, Binod Kumar & Ors., filed a contempt petition challenging an earlier order that had already disposed of their representation on 03‑10‑2025. The petition argued that the contempt petition was now infructuous but sought liberty to assail the order that turned down their claim. The State of Bihar appeared through its counsel. The Patna High Court, after hearing submissions, held that the contempt petition stands closed, granting the petitioners liberty to challenge the order if they so wish. No substantive merits of the contempt claim were examined as the matter was deemed already resolved. The order was pronounced on 16‑01‑2026 by Justice Harish Kumar.

Issues considered

  • Whether the court may grant liberty to the petitioners to assail the earlier order despite dismissal of the contempt petition

Subjects

  • contempt of court
  • writ jurisdiction
  • petition dismissed
  • liberty to assail
