High Court of Gujarat

ADNAN ALIAS BABA AARIFBHAI SHEKHversusTHE STATE OF GUJARAT

Disposal
39-RULE DISCHARGED/DISMISSED @ FH

Holding

The court held that, given the applicant's poor jail conduct and the seriousness of the NDPS charges, there was no ground to grant temporary bail.

Summary

Adnan alias Baba Aarifbai Shekh applied for temporary bail before the Gujarat High Court. The applicant’s jail report indicated poor conduct while he is charged with serious offences under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The respondent, the State of Gujarat, was represented by Ms. Dhwani Tripathi. The court examined whether the applicant’s conduct and the gravity of the NDPS charges justified granting bail. It concluded that the seriousness of the charges and the applicant’s unsatisfactory jail behaviour provided no basis for temporary bail. Consequently, the application for temporary bail was dismissed.
